If you are a U.S. citizen who purchased non-prescription Costa sunglasses before January 1, 2016, and paid Costa a warranty fee to repair or replace those sunglasses damaged by a manufacturer’s defect from August 20, 2013 to February 29, 2020, you may be eligible for a cash payment from a Settlement.

A $4,095,000 Settlement has been reached in a class action lawsuit against Costa Del Mar, Inc. (“Costa”). The lawsuit alleges that Costa violated the Magnusson-Moss Warranty Act because Settlement Class Members that purchased Costa sunglasses backed by a “Lifetime Warranty” within the applicable class period paid Costa a fee to repair or replace those sunglasses damaged by a manufacturer’s defect. Costa denies any wrongdoing. The Parties have reached an agreement to settle the lawsuit.

The Settlement Class includes: All citizens in the United States who (i) purchased a pair of non-prescription Costa sunglasses prior to January 1, 2016; and (ii) paid Costa a warranty fee to repair or replace those sunglasses damaged by a manufacturer’s defect from August 20, 2013, to February 29, 2020.

If you are a Settlement Class Member, you will automatically receive a pro rata (a legal term meaning equal share) cash payment from the Settlement Fund for each eligible repair. Your payment amount will be determined after settlement administration costs and Attorneys’ Fees and Expenses have been deducted from the Settlement Fund.

The Court must decide whether to approve the Settlement and Attorneys’ Fees and Expenses. No cash payments will be provided unless the Court approves the Settlement.
